Terms of Service

1. Acceptance of Terms

By accessing and using Chefry ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Chefry is a platform that connects customers with private chefs and catering professionals. We facilitate bookings, payments, and communication between customers and service providers.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

4. Booking, Payment and Fees

All bookings are subject to availability and confirmation by the service provider. Payments are processed securely through Stripe. Refunds are subject to our cancellation policy.

Chefry's fees are posted at chefry.io/fees, for customers and for chefs: the price the chef sets, the 5% Chefry service fee, card processing at 2.9% plus 30 cents on the amount charged, sales tax, any tip, and the chef's own delivery fee when delivery is chosen, together with the commission rates that apply to service bookings. Chefry charges no delivery fee of its own and uses no third-party delivery service. If Chefry raises any fee on that page by more than 2 percent, listed chefs get written notice at least one month before it takes effect.

5. Service Provider Responsibilities

Service providers are responsible for the quality of their services, compliance with health and safety regulations, and maintaining appropriate insurance coverage.

Chefry is a marketplace. Each chef is responsible for their own food and any coverage they choose to carry, and Chefry does not verify whether a chef carries it. A chef who lists as a permitted home kitchen (MEHKO) confirms that they hold that permit and agrees that Chefry may report their name and permit number to the local enforcement agency after three or more unrelated food safety complaints in a calendar year, or on the agency's request, along with the customers who purchased that day. If you upload a customer list to Chefry, you confirm that you have each person's permission to be contacted about your business by email and by text message. Chefry sends those emails and text messages in your name and at your direction, and honors every unsubscribe and STOP reply. You are responsible for any list you upload, and you agree to indemnify and hold Chefry harmless against any claim, fine or cost arising from messages sent to a person on a list you uploaded without that permission.

6. Limitation of Liability

Chefry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Chefry does not carry liability insurance covering incidents arising from the sale or consumption of food listed on the platform. Chefry is a marketplace; each chef is responsible for their own food and any coverage they choose to carry, and Chefry does not verify whether a chef carries it.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
